Terms & Conditions Long-Term Rentals

Welcome to Ibanista Ltd. These terms and conditions govern the use of our long-term rental property search services in France. By engaging in our services, you agree to these Terms & Conditions in full.
Our services
1.1 Ibanista Ltd provides a professional service to assist foreign clients in finding long-term rental properties in France.
1.2 The process includes an initial phone consultation to discuss the client’s needs, budget, and criteria, followed by a comprehensive property search, liaising and negotiating with landlords and/or agencies.
1.3 Ibanista Ltd does not receive commissions from landlords or agencies, our sole income comes from fees paid by our clients.
Pricing and payment
2.1 Our service fee is split into two payments:
50% upfront: Payable before the search begins.
50% upon successful property placement: Payable once a rental property has been secured for the client.
2.2 The upfront payment is refundable if we are unable to secure a rental property for the client. However, if a client chooses to sign a lease based on a virtual viewing without having visited the property in person and later decides to withdraw from the agreement, the full service fee will remain payable.
2.3 Ibanista Ltd conducts property searches through both real estate agencies and private landlords. The client acknowledges that properties secured through agencies will typically incur additional agency fees, which are separate from and payable in addition to Ibanista’s service fee.
2.4 Ibanista Ltd reserves the right to change the service’s price.
Client obligations
3.1 Clients must provide accurate and detailed information during the initial consultation, including their budget, preferred location, and specific rental requirements.
3.2 Clients must notify Ibanista Ltd promptly if their needs or circumstances change during the search process.
3.3 Exclusivity
By engaging Ibanista Ltd for long-term rental assistance, the client agrees to work with Ibanista on an exclusive basis for the duration of the service. This means the client will not engage other property search agents, relocation services, or third parties to assist with the same rental search, nor independently conduct parallel outreach to landlords or agencies for the same purpose.
The client may terminate the service at any time and receive a refund of the upfront payment, provided no suitable rental opportunity has been secured and the exclusivity clause has not been breached.
If the client chooses to pursue a rental independently or through another provider during the engagement, Ibanista Ltd reserves the right to terminate the service, and the upfront payment will remain non-refundable.
Unsuccessful searches
4.1 If Ibanista Ltd is unable to secure a suitable rental property for the client, the initial 50% payment will be refunded.
4.2 If the client is not satisfied with the progress of the search or chooses to discontinue the service, they may cancel at any time. Provided the exclusivity clause (Section 3.3) has not been breached, the upfront payment will be refunded in full.
4.3 If the exclusivity clause has been breached, no refund of the upfront payment will be issued.
Limitations of liability
5.1 Ibanista Ltd is not responsible for any decisions made by landlords or agencies, including but not limited to rental rejections or delays in response.
5.2 Ibanista Ltd does not guarantee that every client will find a property that meets all specified criteria but will make reasonable efforts to achieve the desired outcome.
Termination of service
6.1 Ibanista Ltd reserves the right to terminate the service at any time with written notice if the search becomes unworkable. This may include, but is not limited to, situations where the client repeatedly changes their criteria, maintains unrealistic requirements, or is unwilling to make reasonable compromises, resulting in an unsuccessful search. In such cases, the upfront payment will be refunded in full.
6.2 The client may terminate the service at any time if they are not satisfied with the progress of the search. In this case, the upfront payment will be refunded in full, provided the exclusivity clause (Section 3.3) has not been breached.
6.3 If the exclusivity clause has been breached, Ibanista Ltd reserves the right to terminate the service, and no refund of the upfront payment will be issued.
Confidentiality
7.1 All client information provided to Ibanista Ltd will be kept strictly confidential and used solely for the purposes of the rental search.
